On 29th of July 2013, the government renamed ‘compromise agreements’ to ‘settlement agreements’.

Don’t sign until you’ve read this

A settlement agreement is a legally binding document that covers the terms under which you are walking away from your rights as an employee.
It usually involves you signing away the right to take your employer to tribunal in return for an agreed payment. It will cover issues such as severance pay, notice periods and payment in lieu.

You don’t need to pay

Your employer will pay for you to get an independent legal review of your settlement agreement because it is in their best interest to make sure you understand what you are signing.

You don’t have to sign

You do have a choice about whether you sign it. We will talk to you about the circumstances that resulted in this situation and whether it makes sense for you to sign.
As far as we are concerned, you are our client and we will make sure you understand exactly what you are giving up to get what they have offered.
We will go through your agreement with you, explaining what it means financially, what rights you are giving up and anything you don’t understand. Our goal is to make sure that:

  • You understand your choices and their implications – settlement agreements are often the best solution to a dispute, but if we think you’d be better bringing a tribunal claim, we’ll tell you.
  • You get a fair deal – if we don’t think you’re getting the best deal, we’ll help you negotiate with your employers over potential issues such as severance pay, payment in lieu, notice periods and any restrictions on your next move into alternative employment.

If you’re not happy, then neither are we.
